Terms of Service

Welcome to MelonTag. By registering or using our SaaS platform, you agree to be bound by these Terms of Service. Please review them carefully before proceeding.

1. Service Provider Information

In accordance with Spanish Law 34/2002 (LSSI-CE), the legal details of the provider are:

2. Service Description & Multi-Tenant Architecture

MelonTag is a cloud software service (B2B SaaS) designed for inventory management, asset traceability, loan tracking, and incident reporting via QR codes. The service includes a web administration dashboard and a mobile field application. The platform operates on an isolated multi-tenant architecture using unique tenant codes (tenant_code).

3. Account Registration & Eligibility

  • Legal Capacity: Registration is intended for schools, educational institutions, businesses, and professionals. The registering user represents that they have the legal authority to bind the registering organization.
  • Data Accuracy: You agree to provide accurate, complete, and updated information during account setup.
  • Credential Security: You are responsible for keeping your login credentials confidential. All actions performed under an account will be deemed executed by the customer organization.

4. Subscription Plans, Billing & Quotas

  • Starter Plan (Freemium): MelonTag offers a free base plan ("Starter") subject to usage limits (20 QR codes quota and 2 users limit per organization).
  • Paid Plans: Paid subscriptions (Professional, Institutional, and School Network) are billed periodically (monthly or annually) via Stripe.
  • Quotas & Limits: Upon reaching asset or user quotas assigned to your plan, new inventory entries will be restricted until an account upgrade is performed.
  • Renewal & Cancellation: Paid subscriptions renew automatically unless canceled by an account administrator prior to the billing date.

5. Acceptable Use & Prohibitions

You agree NOT to use MelonTag for:

  • Any unlawful activities, violating third-party rights, or transmitting malicious code.
  • Attempting unauthorized access to backend systems, databases, or other tenant accounts.
  • Reverse engineering, decompiling, or duplicating the source code or proprietary design of MelonTag.
  • Executing unauthorized automated calls or API abuse that saturates server infrastructure.

6. Data Protection & Data Processing Addendum (DPA)

The processing of personal data is governed by our Privacy Policy. For B2B clients entering personal data (employees, students, borrowers) into the platform, these terms incorporate a Data Processing Addendum (DPA) under Article 28 GDPR, under which MelonTag processes data solely according to customer instructions and safety standards.

7. Geolocation, Photos & Public Asset Cards

  • GPS Geolocation: The platform allows finders of lost items to voluntarily share point-in-time GPS coordinates via the public web browser to facilitate returning the asset to its owner (GDPR Art. 6.1.a). MelonTag does not perform real-time continuous tracking nor collect GPS geolocation in the mobile app.
  • Photos & Files: Customer organizations warrant they hold the necessary rights for equipment photos or invoices uploaded to the platform.
  • Public QR Cards: If an organization enables public QR access for incident reports or asset lookup, it assumes responsibility for the publicly visible information configured.

8. Intellectual Property

MelonTag (including code, design, logos, trademarks, and system architecture) is the exclusive property of Luis Giménez Álvarez. Customer organizations retain full and exclusive ownership over all inventory data and content uploaded to their tenant environment.

9. Warranties & Limitation of Liability

The service is provided "as is" and "as available". While MelonTag maintains high uptime standards and performs regular encrypted backups:

  • We do not guarantee uninterrupted, error-free service at all times.
  • To the maximum extent permitted by law, MelonTag shall not be liable for indirect, incidental, or consequential damages resulting from the use or inability to use the platform.

10. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Spain. Any disputes arising hereunder shall be submitted to the competent courts of Spain.
